A Geneva man was arrested March 13 following an investigation of a domestic dispute that took place involving a woman.
Justin Gallo, 42, of the 300 block of Division Street, has been charged with:
- Attempted Murder – First Degree – Intent to cause death or great bodily harm, Class M felony, 720 ILCS 5/8-4(a) and 720 ILCS 5/9-1(a)(1);
- Aggravated Domestic Battery – with Strangulation, Class 2 felony, 720 ILCS 5/12-3.3 (a-5);
- Aggravated Domestic Battery – Causing Great Bodily Harm, Class 2 felony, 720 ILCS 5/12-3.3(a);
- Unlawful Restraint, Class 4 felony, 720 ILCS 5/10-3;
- Domestic Battery – Causing Bodily Harm, Class A misdemeanor, 720 ILCS 5/12-3.2(a)(1);
- Domestic Battery – Physical Contact of an Insulting or Provoking Nature, Class A misdemeanor, 720 ILCS 5/12-3.2(a)(2);
- Interfering with the Reporting of Domestic Violence, Class A misdemeanor, 720 ILCS 5/12-3.5(a); and
- Violation of an Order of Protection, Class A misdemeanor, 720 ILCS 5/12-3.4(a)(1).
Geneva Police responded to Gallo’s residence at 12:28 a.m. March 13 regarding a domestic disturbance called in by the woman. Officers found the woman having difficulty walking on her own outside of the home. She had multiple abrasions and bruising on her face, as well as a laceration on her left arm.
During the altercation, Gallo allegedly threw the woman on a bed several times and held her down against her will. The woman told officers she passed out after Gallo allegedly sat on her chest while covering her mouth and nose.
According to the woman, once she regained consciousness, Gallo continued his attack by covering her mouth to prevent her from screaming for help out a window. The woman attempted to leave several times but was physically stopped by Gallo, who took her cell phone.
The woman eventually was able to break free and regain possession of her phone to call 911.
The woman, who had suffered multiple broken bones, was transported by the Geneva Fire Department to Northwestern Medicine Delnor Hospital in Geneva.
Gallo later exited the residence to speak with officers. He was treated for minor injuries, which he sustained during the altercation, at Northwestern Medicine Central DuPage Hospital in Wheaton. He was released from the hospital and placed under arrest a short time later.
The Kane County State’s Attorney’s Office authorized the charges against Gallo, who is scheduled to appear for a detention/conditions of release hearing.
Gallo is presumed innocent on all charges until proven guilty in a court of law.
